January 1,
1995
, Real
Estate Brokers and Sales Representatives
are required as members of the Canadian Real Estate Association, Ontario
Real Estate Association and the Muskoka/Haliburtion Association of
Realtors (our Real Estate Board) to disclose the nature of their
Agency relationship to both buyers and sellers with written
acknowledgement. Agency
disclosure insures that the law is clearly understood by the public and
what it means to be represented as a client
versus
a customer.
Traditionally, Real Estate Brokers in
Ontario
represent
the Seller as a client
in a transaction. Consequently,
they owe fiduciary responsibilities of loyalty, obedience,
confidentiality, disclosure and reasonable care and diligence.
Our primary duty is to protect and promote the interests of that
Seller.
At
the same time,
certain duties are owed to the Buyer as a customer.
These include: fairness,
honesty, the legal duty not to misrepresent and to exercise care when
answering inquiries or giving advice.
The
customers
of
Homelife/Muskoka Real Estate Limited are offered a range of services
including assistance regarding market information, property selection,
offer negotiation, drafting agreements, financing and much more.
These services are designed to assist our customers
while ultimately promoting the interests of Sellers selling their
properties.
If
a Buyer wishes
to be represented on a client
basis, our
company would be pleased to do so under a separate contract.
In our client
relationship
with you, from our first meeting to the completion of offers, we shall
disclose and serve you in the most ethical manner possible.
Our job is to bring together willing Sellers and willing Buyers
in successful real estate transactions.
“dual
agency”
arrangement, the REALTOR must do what is best for both the seller and
buyer.
A dual agent must fully disclose information
to both the buyer and seller. No information will be confidential,
other than outlined in the Buyer Contract, and the Listing Contract with
the Seller.
